1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you ("Client," "you") and TAM Digital ("Company," "we," "us," or "our"), concerning your access to and use of the tamdigi.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

By accessing the Site or using our services, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions.

2. Services Provided

TAM Digital provides digital marketing and development services, including but not limited to:

• Website Design & Development
• Social Media Marketing & Management
• Performance Marketing (PPC, Meta Ads)
• Search Engine Optimization (SEO)
• Recruitment & Staffing Services

We make every effort to display as accurately as possible the details of our services. However, we do not guarantee that the descriptions are accurate, complete, reliable, current, or error-free.

3. Payments & Refunds

Payment Terms: Invoices are due upon receipt unless otherwise stated in your specific service contract. Work will commence only after the agreed advance payment is received.

Refund Policy:

• Retainers: Monthly retainer fees for marketing services are non-refundable once the month has started.
• Projects: Deposits for website development or one-time projects are non-refundable once work has commenced.
• Ad Spend: We are not responsible for ad spend paid directly to third-party platforms (Google, Meta, etc.). This budget is separate from our service fee.

4. Intellectual Property Rights

Unless otherwise indicated, the Site and services are our proprietary property.

Client Ownership: Upon full payment, the Client owns all rights to the final website design, code, and content created specifically for their project. TAM Digital retains the right to use the work in our portfolio and case studies.

5. Third-Party Platforms (Disclaimer)

We work with third-party platforms like Google, Facebook, Instagram, LinkedIn, and Amazon. We are not responsible for:

• Changes in algorithms that may affect ranking or reach.
• Account suspensions or bans caused by the platform's policy updates.
• Downtime or technical issues on these platforms.

While we use best practices to prevent these issues, we do not own these platforms and cannot guarantee their performance.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services.

7. Governing Law

These Terms shall be governed by and defined following the laws of India. TAM Digital and yourself irrevocably consent that the courts of Ludhiana, Punjab shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
